Terms and Conditions:
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in the "Win the ultimate surf travel pack from Quiksilver and Surf Travel Online” promotion (“Promotion”) is deemed acceptance of these Terms and Conditions. 
2. The Promotion commences at 9am (AEST) on 1st July 2008 and ends at 5pm (AEST) on 31st August 2008 (“Promotion Period”).
3. Employees of the Promoter and their respective subsidiaries, related companies, affiliates (including any Quiksilver licencees), officers, agents and the immediate family members of each are ineligible to enter. Proof of identity must be furnished upon request.
4. To qualify for entry, Entrants must, during the Promotion Period, complete and submit an entry ("Entry") for the Promotion on the Promotion website at http://www.quiksilver.com/quikopenlakeys . In submitting their Entry, Entrants must answer the question " How you would put this prize pack to good use if you won?" (“Question”) in 25 English words or less, and include Entrant’s name and validly complete each of the required fields on the Promotion website. Entrants may only enter the Promotion once and any additional Entries from the same entrant will be disregarded.
5. There is one prize to be won (“Prize”). The total prize value is up to $AUD1500.00. The prize is subject to availability and conditions.
6. The judging will take place on 31st August 2008 at Jl. Ray legian no. 362, Kuta-Bali, 80361; the best valid Entry for the Prize, as determined by the judges, will win 1x TL2 Surftech surfboard from Surf Travel Online and 1x Quiksilver prize pack including 1x Quiksilver sunglasses, 1x Quiksilver backpack, 1x Quiksilver L/S .5mm wetsuit jacket, 1x Quiksilver Indo Reef Booties, 1x Bleeker Boardshorts (“Prize Winner”).
7. The Prize Winner will be notified by the Promoter by telephone or email within 7 calendar days of its selection. The winner will be required to respond to any email message to acknowledge receipt of the Promoter's notification. The Promoter assumes no liability for any lost or mis-communicated voicemails or emails. If no response is received by the Promoter from the winner within three calendar days following prize notification, the prize will be awarded to a replacement winner to be determined by the Promoter, in the Promoter’s sole and absolute discretion. The winner will be required to prove eligibility to receive and claim any prize.  The Promoter is not responsible for any incorrect or illegible address information or the non-delivery of any prize resulting therefrom, or for any unsuccessful efforts to notify the winner.
8. As a condition of entry, all Entrants agree to be bound by the decisions of the Promoter, which shall be final and binding in all matters relating to the Promotion. No correspondence will be entered in to. This is a game of skill and chance plays no part in determining the winner.  Each valid Entry and response to the Question will be individually judged based on the judge's opinion of the creativity, relevance and humour of the answer provided to the Question. Incomplete, indecipherable, or illegible Entries will be deemed invalid.
9. In the event that a Prize Winner is under eighteen years of age, the Prize will be awarded to the Prize Winner’s parent/s or legal guardian. 
10. All prizes are "AS IS" without any warranty of any kind, express or implied or any responsibility for any damage to the prizes during transit or use. Prizes are non‑transferable or exchangeable and cannot be taken as cash.  The Promoter may, in its discretion, substitute any prize (or a part of that prize) with a prize to the equal value and/or specification.
11. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process or Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
12. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents and the Promoter's respective subsidiaries, related companies, affiliates (including Quiksilver Inc any related entities) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the Prize Winner; (f) any prize; or (g) or any loss or injury however caused to the winner or the winner's companion, as a direct or indirect result of accepting the prize.
13. All Entries become the property of the Promoter and Entries will not be returned to any Entrant.  As a condition of entering into this promotion, each Entrant licenses the Promoter to use their Entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes without further notice or remuneration. Each Entrant warrants to the Promoter that each Entry submitted is an original literary work of the Entrant that does not infringe the rights of any third party.  The Entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.  Entrants consent to any use of their Entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
14. The Promoter shall not be responsible for any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to the participant’s or any other person’s computer related to or resulting from downloading or viewing any part of this competition or the Promotor’s website.  Any attempt to deliberately undermine the legitimate operation of this Competition is a violation of the terms and conditions of this Promotion and the Promoter reserves the right to seek remedies and damages to the fullest extent permitted by law. The Promoter reserves the right to cancel this Promotion at any time in its sole discretion if the Promotion is compromised in any way, or in the event that any viruses or bugs or other causes beyond its control corrupt the administration, security or intended operation of the Promotion. The Promoter further reserves the right to modify the rules of the Promotion, as long as reasonable notice is given.
15. The Prize Winner consents to the use of their name, suburb of residence, image and Entry for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter.
16. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose disclose such information to third parties, including, but not limited to, prize suppliers.  Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes. The personal information of Entrants will be held and used in accordance with the Promoter’s Privacy Policy, which is available here
